La pregunta planteada en el título de este trabajo reitera una alternativa que se ha transformado en un locus classicus de la teoría política: ¿el orden político forma parte de la constitución racional de la realidad y, por ello, no necesita ser creado pues basta con descubrir su existencia como una entidad más entre los entes de la naturaleza? ¿O ese orden político solo existe cuando es instituido por el hombre y, por ello, es el resultado de un acto de (...) la voluntad humana? No analizaré aquí cada una de esas dos posiciones, naturalista la primera y voluntarista la segunda, sino que intentaré mostrar cuál fue la respuesta de la teología política de Egidio Romano y de Carl Schmitt a la pregunta por el origen del Estado. A teoria política medieval possui uma singularidade, pois trata de “dois poderes” distintos – reino e o sacerdócio –, sendo necessário definir como se dão as relações entre eles. Durante o debate entre Bonifácio VIII e Filipe, o Belo, foi importante a obra de João Quidort. Ele criticou a teoria da plenitude do poder, atribuída pelos curialistas ao papa, e procurou mostrar a diferença entre os modos de causalidade que explicam cada um dos dois poderes. How can science be brought to connect with experience? This book addresses two of the most challenging problems facing contemporary neurobiology and cognitive science. Firstly, understanding how we unconsciously execute habitual actions as a result of neurological and cognitive processes that are not formal actions of conscious judgment but part of a habitual nexus of systematic self-organization. Secondly, attempting to create an ethics adequate to our present awareness that there is no such thing as a transcendental self, a stable subject (...) or soul. Tomás de Aquino diferencia como dos principios metafísicos diferentes la suma de de-terminaciones que especifican como tal a un ente y el hecho de que dicho ente efecti-vamente exista en la realidad. Ahora bien, al definirse como lo otro de la esencia el ser tiende a devenir él mismo una especie de esencia que requiere, al igual que la esencia propiamente dicha, ser puesto a su vez en la existencia. Este corolario fue derivado de la tesis de la distinción real (...) ya en tiempos del propio Tomás por pensadores como Egidio Romano y recogido luego a lo largo de la Edad Media hasta los tiempos de Francisco Suárez. El neotomismo del siglo XX intentó eludir ese corolario echando mano del ar-gumento de la causalidad recíproca entre el ser y la esencia: el ser pondría a la esencia en la existencia y con el ser así recibido la esencia limitaría correlativamente al ser. No obstante, la distinción real del ser y la esencia parecería no poder evitar que el ser se convierta como tal en un ente sui generis que consecuentemente reproduce en su propio interior la estructura doble de esencia y ser. El presente trabajo tiene por objeto analizar en detalle las dificultades que plantea la tesis de la causalidad recíproca para fundamen-tar la tesis de la limitación del ser por la esencia. (shrink)

This article critically examines the development and consensus outputs of the Concussion in Sport Group. We examine the six Consensus Statements between 2001 and 2023 to explore the challenges that the presence of contextual forces pose to the development of effective and ethically justifiable medical guidelines to manage situations involving brain-injured athletes. First, we discuss the implicit and explicit ethical framework and goals underlining the statements. Secondly, drawing on a relational account of athlete choice, we expound on the limitations of (...) the framework, concentrating on those resulting from a simplified understanding of athlete autonomy. Thirdly, we conclude by proposing a series of recommendations to improve concussion management protocols: (1) adopting a broader understanding of autonomy built upon relational accounts, beyond just the healthcare professional-athlete relationship; (2) further minimizing conflicts of interest that increase athletes’ vulnerability and hinder decision-making ability; (3) enhancing healthcare professional training to allow better adjustment of treatment plans to athletes’ contexts; and (4) promoting research on sociocultural elements affecting athletes’ vulnerability and autonomy. This paper considers, firstly, to what extent the administration of oxytocin can augment the capacity of empathy in human beings; and secondly, whether or not such practice ought to be allowed. In relation to the latter, the author develops an argument in favour of this intervention by virtue of its consistency with the belief that, if a therapeutic treatment is to be considered acceptable, it is essential that it maximizes the well-being of those affected and that it does not compromise (...) the autonomy of the patient. Having rejected several objections related to the nature of this intervention, the author finally questions its morality on the basis of a concern with its universalizability. (shrink)

This study attempts to analyse the relationship between two key psychological variables associated with performance in sports - Self-Determined Motivation and Competitive Anxiety - through Bayesian Networks analysis. We analysed 674 university students/athletes from 44 universities that competed at the University Games in México, with an average age of 21 years (SD = 2.07) and with a mean of 8.61 years’ (SD = 5.15) experience in sports. Methods: Regarding the data analysis, first a CHAID algorithm was carried out to determine (...) the dependence links between variables, and then a Bayesian networks was developed. The validation of the BN revealed AUC values ranging from 0.5 to 0.92. Subsequently, various instantiations were performed with hypothetical values applied to the “bottom” variables. Results showed two probability trees that have extrinsic motivation and amotivation at the top, while the anxiety/activation due to worries about performance was at the bottom of the probabilities. The instantiations carried out support the existence of these probabilistic relationships, demonstrating their scarce influence on anxiety about competition generated by the intrinsic motivation, and the complex probabilistic effect of introjected and identified regulation regarding the appearance of anxiety due to worry about performance. Frente a los problemas suscitados por la postulación cartesiana de una intuición intelectual perfecta del yo pensante, y frente a la escisión del yo (...) puro y el yo empírico operada en Kant, Canals propone una ontología del sujeto basada en la metafísica del conocimiento de Tomás de Aquino, donde el sujeto finito intelectual sensible compuesto que es el hombre se interpreta en el plano de la naturaleza intelectual. En este trabajo me propongo comparar el patrón argumentativo de los sofistas del siglo V a. C. tal como son retratados en la obra de Platón con el de los erísticos del _Eutidemo_. Defenderé que ninguno de estos sofistas es presentado por Platón como experto en dialéctica refutativa, actividad discursiva que caracteriza a la erística. Por el contrario, el retrato platónico de Pródico, Hipias, Gorgias y Protágoras los muestra como incapaces, desinteresados u hostiles a la argumentación de tipo dialéctica.

What would it mean for an emotion to successfully “recognize” something about an object toward which it is directed? Although the notion of "emotional recognition" is central to Rick Furtak’s _Knowing Emotions_, the text does not provide an account of this concept that enables us to assess the extent to which a given emotional response is recognitive. This article draws from the text to articulate a novel account of emotional recognition. According to this account, emotional recognition can be assessed not (...) only in terms of the “accuracy” of an emotional construal in a strictly epistemological sense, but also in terms of the quasi-ethical ideal of responding emotionally to what we encounter in ways that are “specific,” “deep," and “balanced.". Stephen Jay Gould’s monumental The Structure of Evolutionary Theory ‘‘attempts to expand and alter the premises of Darwinism, in order to build an enlarged and distinctive evolutionary theory . . . while remaining within the tradition, and under the logic, of Darwinian argument.’’ The three branches or ‘‘fundamental principles of Darwinian logic’’ are, according to Gould: agency (natural selection acting on individual organisms), efficacy (producing new species adapted to their environments), and scope (accumulation of changes that through geological time yield (...) the living world’s panoply of diversity and morphological complexity). Gould’s efforts to contribute something important to each of these three fundamental components of Darwinian Theory are far from successful. (shrink)

Despite the public availability of legal documents, there is a need for finding specific information contained in them, such as paragraphs, clauses, items and so on. With such support, users could find more specific information than only finding whole legal documents. Some research efforts have been made in this area, but there is still a lot to be done to have legal information available more easily to be found. Thus, due to the large number of published legal documents and the (...) high degree of connectivity, simple access to the document is not enough. It is necessary to recover the related legal framework for a specific need. In other words, the retrieval of the set of legal documents and their parts related to a specific subject is necessary. Therefore, in this work, we present a proposal of a RDF-based graph to represent and search parts of legal documents, as the output of a set of terms that represents the pursued legal information. Such a proposal is well-grounded on an ontological view, which makes possible to describe the general structure of a legal system and the structure of legal documents, providing this way the grounds for the implementation of the proposed RDF graph in terms of the meaning of their parts and relationships. We posed several queries to retrieve parts of legal documents related to sets of words and the results were significant. (shrink)

O populismo contemporâneo tem suscitado profícuos debates entre os teóricos políticos, tais como Ernesto Laclau, com a sua teoria do discurso atrelada à psicanálise, defendendo a ideia de que o populismo representa a lógica da política; e Nadia Urbinati, que compreende o populismo como a desfiguração da democracia. O desdobramento deste embate de ideias levará à análise de uma figura importante para o populismo: o líder populista. Se para Laclau a noção de _significante vazio_ expressa o sujeito coletivo na figura (...) do líder, resultado da lógica da equivalência e da diferença entre as diversas demandas sociais, para Urbinati o líder populista utiliza o regime democrático para atingir fins antidemocráticos, aviltando a parte da população que dele diverge. Pretende-se neste artigo analisar ambas as concepções e, a partir do confronto destas perspectivas sobre o populismo, apresentar uma hipótese de base psicanalítica sobre o que conduz os indivíduos a apoiarem uma representação política autoritária. This work proposes an interpretation of Euthydemus 283c-288b taking into account the problem of the false in the Sophist. My hypothesis will be that the second eristic demonstration of the Euthydemus can be understood as a representation of Sophist 236d-239b: while in this passage there it is the Stranger is the one who states what the sophist would say to defend himself from the seventh definition, in which he is accused of producing falsehoods, in the Euthydemus two sophists are who (...) use the notions of non-being and falsehood to refute such accusation. The work has three parts. Firstly, I shall analyze Sophist 236d-239b and contextualize it within the framework of the seventh definition. Secondly, I focus on the characterization of Euthydemus and Dionysodorus as sophists. Finally, I analyze the three arguments that organize the second demonstration of the Euthydemus, trying to understand its structure and its role in the drama of the dialogue. (shrink)

Primero, se trata de reconocer la juvenil admiración del filósofo por la ópera wagneriana entendida como un renacimiento del drama musical antiguo. Luego, se explora el tránsito hacia su desilusión en la clave de la influencia de Schopenhauer sobre Wagner. Finalmente, el ensayo remata en la crítica madura de Nietzsche sobre Wagner, donde se advierten los prolegómenos decimonónicos de la transformación (...) general del arte en espectáculo en el sentido contemporáneo. Un joven Schelling escribe bajo este sol naciente una obra en (...) la que el arte aparece como una praxis capaz de suturar aquella herida que abre la conciencia. La imaginación y la síntesis poética son elementos ineludibles en el transitar por una vida humana que busca su plenitud en el retorno a la unidad originaria con lo Absoluto. Socrates can be said to have left the subsequent philosophical tradition with the problem of the relation between philosophy and politics. Already in the Republic the proposal of philosopher-kings represents more a tension than an identity. While Aristotle responds by insisting on a sharp distinction between politics and philosophical wisdom, this distinction proves on closer examination much less sharp than might appear. Heidegger characterizes philosophy as the only authentic politics and the philosopher as ruling just by virtue of being a (...) philosopher. In contrast, Foucault insists that, if philosophy can play a role in relation to politics by transforming the subject who lives politically, it plays no role within politics. In this contrast can be seen the 'fallout' of the tension bequeathed by Socrates through both Plato and Aristotle. Podría decirse que Sócrates le dejó a la tradición filosófica posterior el problema de la relación entre filosofía y política. Ya en la República la propuesta del rey filósofo representa más una tensión que una identidad. Mientras que la respuesta de Aristóteles insiste en una clara distinción entre la política y la sabiduría filosófica, un examen cuidadoso demuestra que esta distinción es menos clara de lo que parece. Heidegger caracteriza la filosofía como la única política auténtica y al filósofo como gobernante por el mero hecho de ser filósofo. En contraste, Foucault insiste en que si bien la filosofía puede desempeñar un papel en relación con la política al transformar al sujeto que vive políticamente, aquella no desempeña papel alguno dentro de la política. Este contraste ilustra el resultado de la tensión legada por Sócrates a través de Platón y Aristóteles. (shrink)

The theory of punctuated equilibrium has been proposed as a challenge to the modern synthesis of evolutionary theory. Two important issues are raised. The first is scientific: whether morphological change as observed in the paleontological record is essentially always associated with speciation events. This paper argues that there is at present no empirical support for this claim: the alleged evidence is based on a definitional fallacy. The second issue is epistemological: whether macroevolution is an autonomous field of study, independent from (...) microevolutionary knowledge. It is herein argued that macroevolution and microevolution are not decoupled in two senses: identity at the level of events and compatibility of theories. But macroevolution is autonomous in the epistemologically important sense: macroevolutionary theories are not reducible to microevolutionary principles. It is finally pointed out that the discipline of macroevolution is notoriously lacking in theoretical constructs of great import and generality. (shrink)

Cloth, $59.95.This rewarding book not only is another sign of growing interest in the Statesman, but also does much to justify this interest. The reasons for the dialogue’s relative neglect until recently are easily stated: readers have been puzzled (...) by the amount of space devoted to method in a dialogue ostensibly about politics; furthermore, they have found both the method and the politics highly unsatisfactory. Lane addresses each of these concerns. She continually draws our attention to the unity of method and politics in the dialogue: the limitations of the Stranger’s initial divisions are shown to be equally methodological and political (44–5); the cosmic story is shown to be flawed by a political prejudice (the traditional model of king as shepherd), which turns into a methodological prejudice (the telling of a story too long to be profitably used as an example; 9–10, 121–3); the capacities ultimately shown to be necessary for a successful inquiry (division, exemplification, and finding the mean) also prove to be essential requirements of political knowledge (143–4, 202).Lane’s major contribution to our understanding of the dialogue’s method is her demonstration of the central role played by example (paradeigma). Lane expresses a common objection to the method of division: “But how to choose just which apparently similar things or names to investigate? Similarities are ubiquitous; there is some respect in which everything is similar to everything else. What is more, it is usually on the basis of prejudice and preconceived ideas … that similarities are distinguished” (75–6). Lane sees example as the solution, since it is precisely the task of an example to fix on those similarities relevant to the aim of the inquiry (76, 86–7).This is a very appealing solution, but one must wonder if it does not simply postpone the problem. To choose the right example, must we not make assumptions about which similarities are relevant to defining the object of inquiry and therefore about the nature of this object? And may not these assumptions be no more than prejudices or preconceived ideas? While the Stranger indeed develops his own example of weaving to an extent unparalleled in other dialogues (93), that there are essential similarities between statecraft and weaving appears to be more assumed than demonstrated by the example.With regard to politics, Lane provides a very illuminating account of the dialogue’s characterization of political expertise as certain knowledge of the good in a temporal context, or the kairos. She shows in what way this “knowledge of timing” (142) both is distinct from, and rules over, other contenders for the title of statecraft (such as rhetoric and strategy).Since, however, the existence of a statesman possessing such political expertise is, from the dialogue’s perspective, “a logical but unlikely possibility” (111) and, “from a [End Page 159] modern perspective,” seemingly impossible (4–5), the practical value of the Stranger’s political theory depends on his claim that the regimes which do exist can ‘imitate’ this ideal (300e11–301a3). But how? Even the second-best regimes are characterized by strict adherence to laws based on nothing more than persuasion, experiment and majority consensus (300b1–6), while in the ideal regime a knowledgeable statesman creates laws only as “memoranda” which he is entitled to revise or revoke at any time. According to Lane there is nevertheless one similarity that allows the second-best regimes to be called “second-order imitations” (see 109–111) of the ideal: both will not change laws without expert advice (158–9). This assumes that the second-best regimes acknowledge the authority of a political expert to change the laws, should one appear, an assumption that Lane reiterates throughout the book (11, 111, 114, 139, 147).Yet it is precisely this assumption that appears to be refuted by the thought-experiment at 298a–299e.
